I own a California business and am teetering on bankruptcy. Do I file under federal bankruptcy law or must I use California provisions?
Federal law controls bankruptcy filings, applicable law and procedures. All bankruptcy matters are filed in the United States Bankruptcy Court in the District in which the business has its principal place of business. California insolvency law is superceded by Federal bankruptcy law and, in any case, is not advantageous as a general rule. There may be exceptions.
